These Terms of Service ("Terms") govern your use of the CatalogX platform (the "Service") operated by CatalogX ("we", "our", "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement and that the information you provide is accurate and complete.

2. Account Registration

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Service Description

CatalogX provides an AI-powered virtual try-on service that generates photorealistic images of people wearing specified garments. The Service uses generative AI technology and third-party APIs to produce these images.

4. Acceptable Use

You agree not to use the Service to:

• Upload images of people without their consent
• Generate images that are obscene, offensive, defamatory, or illegal
• Create deepfakes or misleading content intended to deceive others
• Impersonate another person or misrepresent your identity
• Infringe on any third party's intellectual property rights
• Upload malicious files, viruses, or harmful content
• Attempt to reverse-engineer, decompile, or hack the Service
• Use automated tools to scrape or bulk-access the Service beyond the provided API
• Resell or redistribute the Service without our written permission

5. Credits and Billing

• The Service operates on a credit-based system. Each virtual try-on generation consumes one credit.
• Free accounts receive a limited number of credits as specified on our pricing page.
• Paid plans provide additional credits and features as described at the time of purchase.
• Credits are non-transferable and non-refundable unless required by applicable law.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.
• Failed generations due to system errors will not consume credits. If a credit is incorrectly deducted, contact support for a refund.

6. Intellectual Property

Your content: You retain ownership of images you upload and the generated mockup images. By uploading content, you grant us a limited license to process your images solely for the purpose of providing the Service.

Our content: The Service, including its design, code, AI models, pre-built model images, background templates, and documentation, is owned by CatalogX and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content.

Generated images: You may use generated images for personal and commercial purposes, including product listings, marketing materials, and social media. You are responsible for ensuring your use complies with applicable laws and does not infringe on third-party rights.

7. AI-Generated Content Disclaimer

• Generated images are produced by AI and may not be perfectly accurate representations.
• We do not guarantee that generated images will match real-world appearance of garments.
• You are responsible for reviewing generated images before using them commercially.
• We are not liable for any business decisions made based on AI-generated mockups.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Third-Party Services

The Service integrates with third-party services including OpenAI for image generation and Google for authentication. Your use of these integrations is subject to the respective third party's terms and privacy policies. We are not responsible for the practices of third-party services.

10. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted access to the Service.
• We may perform maintenance, updates, or modifications that temporarily affect availability.
• We are not liable for any losses resulting from Service downtime or unavailability.

11. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind.
• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless CatalogX and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third party's rights.

13. Termination

• You may terminate your account at any time by contacting us.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, your right to use the Service ceases immediately.
• We may retain certain data as required by law or for legitimate business purposes.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CatalogX operates, without regard to conflict of law principles.
